MEDIA TERMS & CONDITIONS – KOOYONG CLASSIC
These Media Terms & Conditions relate to the Kooyong Classic event at Kooyong from 10th – 13th January, 2017.
International Management Group of America Pty Limited (IMG) is the event organiser and promoter.
Accreditation will be subject to the applicant complying with the following Terms & Conditions. The applicant confirms that he is making this application for accreditation with the full knowledge and consent of his employer. The applicant further confirms that he is authorised to enter into this legally binding agreement for himself and on behalf of his employer and that his employer will be bound by these Terms & Conditions. Where the applicant is a freelancer he is classed as the employer. Failure to abide by these Terms & Conditions may result in the applicant or the employer’s accreditation being revoked, prosecution for criminal trespass and/or accreditation being denied in the future.
Applications for media accreditation for this tournament must be made through the Kooyong Classic’s online application web page http://kooyongclassic.com.au/contact-us/media/.
2. Key Obligations
- a) (i) The applicant will abide by and comply with any terms of entry into the tournament venue as prescribed from time to time by the Kooyong Classic or the Kooyong Lawn Tennis Club (‘KLTC’), to the extent those terms of entry do not directly and materially conflict with the rights attaching to the accreditation.
- b) (ii) The applicant will abide by all reasonable directions of Kooyong Classic media staff whilst at the tournament venue.
- c) (iii) The applicant will at all times whilst in the grounds:-
- Wear such identifying pass and/or bib as may be provided by the Kooyong Classic.
- Such pass and/or bib must be visible at all times; and
- Not tamper with any of such items or do anything to obscure any part of them.
- d) The applicant must only capture and use information, audio-visual material and images from the Kooyong Classic event for genuine news reporting purposes and must not itself commercialise or facilitate a third party commercialising such material.
3. Liability & Indemnity
The applicant and the employer (if any) assume all risk incident to attendance at the tournament, agree they are not acting on behalf of the Kooyong Classic, are not employees or agents of the Kooyong Classic and agree to release the Kooyong Classic, KLTC and IMG, from and against any and all liability, loss, damage, expense and/or injury arising from the issuance, use or revocation of the accreditation or in conjunction with applicant’s presence at the tournament. The applicant and the employer (if any) jointly and severally hereby indemnify and hold harmless the Kooyong Classic, KLTC, and IMG, and their respective employees, officers and agents against any and all liability, loss (including consequential loss), damage or expense resulting from a breach of these Terms and Conditions, the issue or revocation of accreditation, the applicant’s presence at the tournament and the applicant’s use of any tournament transportation, services or hotels.
4. Accreditation not Transferable
The applicant and the employer (if any) acknowledge that any accreditation granted in respect of the applicant is personal to the applicant and may not be transferred or assigned to any other person.
5. Grant of Request
The Kooyong Classic may grant or reject the request for accreditation in its absolute discretion and after imposing such further terms and conditions as it sees fit. Once granted, the Kooyong Classic may revoke accreditation at any time in its absolute discretion without being liable to compensate the applicant, the employer or any other person.
The Kooyong Classic or its representatives may ask an accredited member of the media to substantiate the work being undertaken at any tournament by requesting evidence of their work. If requested, this evidence must be provided as soon as is practicable and no later than 24 hours after the initial request. Should this material not be provided, the Kooyong Classic may withdraw this accreditation.
The applicant agrees to conduct himself in a way that will not bring these matches and/or the game of tennis into ridicule or disrepute and will behave at all times in a manner to be expected of a professional in his field and in accordance with any applicable requirements of the International Tennis Federation (ITF) and the Association of Tennis Professionals (ATP). The applicant agrees not to interfere with other media, spectators, players, teams or matches and agrees to refrain from any behaviour that is offensive, aggressive or discourteous. The Kooyong Classic reserves the right to withdraw accreditation (effectively immediately) if it considers that the applicant has breached any of these requirements.
The applicant acknowledges that he is subject to the rules of the Uniform Tennis Anti- Corruption Program published by the International Tennis Federation. By accepting Kooyong Classic accreditation, the applicant agrees that any information he receives on the basis of this media accreditation shall be for the sole purpose of media reporting. The information obtained through accredited media status shall not be used or disclosed by the applicant for the purposes of obtaining financial gain, directly or indirectly, from gambling, betting, gaming or any other form of financial speculation.
8. Data Protection
The Kooyong Classic may use the applicant’s personal information (including photographs) for the purpose of: assessing a request for accreditation, administration, marketing and possibly vetting/security checking. The Kooyong Classic may disclose the applicant’s information to its service providers and agents for these purposes.
Nothing in these Terms and Conditions permits the applicant to compile scoring, statistical or other data or to provide or sub-license to a third party the right to provide a statistics service in
relation to the Kooyong Classic using data sourced from within the event venue by the applicant.
These Terms & Conditions shall be governed by and construed in accordance with Australian law. The Kooyong Classic reserves the right (without prejudice to any other right or remedy it may have) to withdraw accreditation at any time if the applicant breaches any of these Terms and Conditions.
